Notice of Adoption/Passing
City Council adopted Official Plan Amendment No. 13 and passed By-law 205-2024, a Zoning By-law Amendment at 1191 Balsam Street, on the 17th day of June 2024.
The Official Plan Amendment is exempt from approval by the Minister of Municipal Affairs and Housing and the decision of Council is final if a notice of appeal is not received before or on the last day for filing a notice of appeal, July 11, 2024.
How to appeal a decision:
Individuals, corporations and public bodies may appeal to the Ontario Land Tribunal (OLT) in respect of the decision by completing the Appeal Form A1 available from the OLT website at www.olt.gov.on.ca/forms and submitting it to the City Clerk no later than the 11th day of July 2024.

The Appeal Form A1 must set out the reasons for appeal, accompanied by the prescribed fee ($1100.00, certified cheque or money order payable to the Minister of Finance).
Purpose and effect of amendments
The purpose of the Official Plan Amendment No.13 is to amend the City of Thunder Bay Official Plan, as amended, as it applies to 1191 Balsam Street. Specifically, this Amendment permits an additional residential unit, in the form of a second detached house, on a parcel of land that is serviced by private well and septic systems.
The effect of this Amendment is to support the zoning regulations required to allow the former detached house, which is currently being used for storage, to be used as a dwelling again.
The purpose of By-law Number 205-2024 is to amend the City of Thunder Bay Zoning By-law 1/2022, as amended, as it applies to 1191 Balsam Street. Specifically, this By-law increases the maximum number of homes from one per lot to two per detached houses and permits one detached house per lot plus the former detached house.
The effect of this By-law would be to allow the former detached house, which is currently being used for storage, to be used as a dwelling again.
Official Plan Amendment No. 13 and By-law Number 205-2024 apply only to the lands described in By-law Numbers 204-2024 and 205-2024. They do not affect any other lands. A key map showing the location of the lands to which these amendments apply is shown below.
The subject lands are not subject to any other application under the Planning Act at this time.

This Official Plan Amendment was approved under Section 17 of the Planning Act, R.S.O. 1990, as amended. This Zoning By-law Amendment was approved under Section 34 of the Planning Act, R.S.O. 1990, as amended.
All comments received were considered as part of Council’s decision-making process. Council has determined that the application is consistent with all relevant planning legislation and represents good planning.

Right to appeal
Only individuals, corporations and public bodies may appeal a decision of the municipality or by-law to the Ontario Land Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
No person or public body shall be added as a party to the hearing of the appeal unless, before the plan was adopted or the by-law was passed, the person or public body made oral submissions at the public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
Please note that the rights of third parties to appeal zoning by-law amendment decisions to the Ontario Land Tribunal have been restricted under the Planning Act.
